The short version
GEMS is a free guide to what is on in Oslo. It is not a ticket seller, a venue or an event organiser.
Event times, prices, age limits and opening hours come from other companies and from the venues. They change, and they can be wrong. Always check with the venue or the ticket seller before you go.
When you buy a ticket, you buy it from someone else, on their terms.
You are responsible for your own night out. Follow age limits and the law, and look after yourself and others.
1. Who we are
GEMS is made by Nomad, in Oslo, Norway. "We" and "us" in these terms means Nomad. You can reach us at support@gemsapp.no.
2. These terms
These terms apply when you use the GEMS app and this website. By using GEMS, you accept them. If you do not accept them, do not use GEMS.
How we handle personal data is described in our privacy policy. It is part of these terms.
3. What GEMS is, and what it is not
GEMS collects information about events, clubs, bars and places to eat in Oslo, and shows it in one place. Some of it comes from ticket sellers (such as Ticketmaster, Billetto and Rockefeller), some from venues' own websites and other public sources, and some is written by us.
GEMS does not sell tickets, run venues, organise events or serve food or drink. We do not decide who gets in, what anything costs, or whether an event goes ahead.
Our picks are our opinion. "Featured", "Our pick", "Trending" and similar labels are our own choice. Venues and organisers do not pay for them. A pick is not a promise that you will have a good time, or that a place is safe, open or suitable for you.
4. Information can be wrong or out of date
We work to keep GEMS accurate, but we cannot check every detail, and the sources change without telling us. So we cannot guarantee that any information in GEMS is correct, complete or up to date. This includes:
- dates, start times and end times, and whether an event is cancelled, moved or sold out;
- prices, age limits, dress codes and entry rules;
- opening hours, and whether a kitchen is still serving;
- addresses, maps, distances and walking directions;
- descriptions, photos and performers.
Some things in GEMS are estimates by design: how busy a place is, how a night usually fills, when a kitchen closes, how long an event lasts. They are guides, not facts.
Always check with the venue or the ticket seller before you go, especially before you buy a ticket, travel, or plan around a time.
5. Tickets and other websites
Links in GEMS, such as "Buy tickets" and venue websites, take you to other companies. They are not part of GEMS, and we do not control them.
Any purchase you make there is an agreement between you and that company, on their terms. Questions about tickets, payments, refunds, cancellations, changes or entry go to the seller or the organiser, not to us.
We are not responsible for other websites, what they contain, or how they handle your data.
6. Your night out is your responsibility
- Age limits. Many clubs and events have age limits, often 18, 20 or 23. GEMS shows them when a source gives them, but the venue decides at the door. Bring ID.
- Alcohol. GEMS lists bars and places that serve alcohol. It does not encourage drinking. Follow Norwegian law, including the age limits for buying alcohol, and never drink and drive.
- Getting there. Distances and directions are estimates. Use your own judgement, follow traffic rules, and do not use the app while driving or cycling.
- Venues. What happens at a venue or an event is the responsibility of the venue, the organiser and the people there. We do not control it.
7. Reminders and calendar
GEMS can remind you before an event you saved, and add events to your calendar. Reminders depend on your phone's settings, battery and system, and may arrive late or not at all. A calendar entry is a copy of what GEMS knew when you added it; it does not update if the event changes. Do not rely on them alone.
8. Accounts
You can use all of GEMS without an account. An account only keeps your favorites when you change phones.
- You must be at least 13 years old to create an account.
- Keep access to the email address, Apple ID or Google account you sign in with. Anyone who can read that email can sign in to your GEMS account.
- You can delete your account at any time in the app, under Account.
- We may suspend or delete an account that breaks these terms, is used to harm GEMS or others, or is used in a way the law does not allow.
9. How you may use GEMS
GEMS is for your own personal use. You may not:
- copy, collect or resell GEMS's listings, texts or picks in bulk, by hand or with automated tools;
- try to get around how GEMS works, overload it, or reach parts of it you are not meant to reach;
- take apart or copy the app, except where the law allows it;
- try to manipulate what GEMS shows, such as Trending;
- use GEMS for anything illegal.
10. Who owns what
The GEMS name, logo, design, app and our own texts belong to Nomad. Using GEMS does not give you any rights to them.
Event information, photos and other content from ticket sellers, venues and other sources belong to them. We show it to help you find what is on.
If you think something in GEMS uses your content or rights without permission, write to support@gemsapp.no. Tell us what it is and where it appears. We will look at it quickly and remove it if it should not be there.
11. Changes, and if GEMS stops
GEMS is free. We may change, add or remove features, change what is listed, or pause or end the service. We will try to give notice of big changes, but we cannot promise that GEMS will always be available or work without errors.
12. Our responsibility
GEMS is provided as it is and as available, without promises beyond what these terms say.
As far as Norwegian law allows, we are not responsible for loss or damage that comes from:
- information in GEMS that is wrong, missing or out of date;
- events that are cancelled, moved, changed or sold out, or venues that are closed or refuse entry;
- tickets, purchases, refunds or anything else between you and another company;
- other websites and services that GEMS links to;
- reminders or calendar entries that are late, missing or wrong;
- GEMS being unavailable, slow or not working as expected;
- indirect losses, such as wasted travel, lost time or lost income.
What these terms do not limit. Nothing in these terms removes rights you have under Norwegian consumer law that cannot be removed by agreement. Nothing limits our responsibility for damage we cause on purpose or through gross negligence, or for anything else the law does not allow us to exclude.
13. Apple
If you got GEMS from the App Store, these points also apply:
- These terms are between you and Nomad, not Apple. Nomad, not Apple, is responsible for GEMS and its content.
- Apple has no duty to provide maintenance or support for GEMS.
- If GEMS does not work as these terms say, you can tell Apple, and Apple may refund the price you paid (GEMS is free, so that is nothing). Apple has no other warranty duty for GEMS, as far as the law allows.
- Apple is not responsible for claims about GEMS from you or anyone else, including product liability, claims that GEMS breaks a law or regulation, consumer protection claims, or claims that GEMS infringes someone's rights. Nomad handles those, as far as these terms say.
- You confirm that you are not in a country under a US government embargo and not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries can enforce these terms against you as a third party.
- Questions and complaints about GEMS go to support@gemsapp.no.
14. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change matters for you, we will say so in the app or on this website before it takes effect. If you keep using GEMS after that, the new terms apply.
15. Law and disputes
These terms follow Norwegian law. If we disagree about something, write to us first; most things can be solved that way.
If not, the case goes to the Norwegian courts, with Oslo tingrett as the first court. If you are a consumer, you can also bring a case where you live, and you can ask Forbrukerrådet (the Norwegian Consumer Council) for help.
